Recently, by the Law of the Republic of Azerbaijan dated March 7, 2012 the significant changes relating to legal entites have been made to the Criminal Code.
Thus, according to the law, the criminal responsibility of legal entities is envisaged. The principles and conditions of the application of criminal law measures to legal entities is the commitment of criminal acts by physical persons acting in favor of or for the protection of the legal persons’ interests. According to Article 99-4.6 of the Criminal Code, criminal law measures shall apply for committing of a number of acts provided for in the same Code. These include kidnapping, false entrepreneurship,an acquisiton of the criminally obtained money or of other property, terrorism, cyber crimes, misuse of power, bribe taking and giving, illegally influencing the official's decision, forgery, dissemination of confidential information about victims of human trafficking,dissemination of the information relating to combat against legalization of the criminally obtained money or of other property or of information on measures combating the financing of terrorism.
For this purpose the criminal law measures such as, a fine, a special confiscation, deprivation of the right of the legal person to be engaged in the specific activity, a liquidation of the legal person are envisaged.
